By accessing and using SmartFusion, you agree to be bound by these Terms of Use and any policies and guidelines referenced herein. If you do not agree with any part of these terms, you must not use our software.

User Accounts To access features of SmartFusion you are required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account. We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.

License to Use We grant you a non-exclusive, non-transferable, revocable license to use SmartFusion strictly in accordance with these Terms of Use. You may not use the software for any illegal purpose or in any manner inconsistent with these terms.

User Conduct You agree not to use SmartFusion to:

• Upload, post, email, or otherwise transmit any material that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Harm minors in any way.
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.

Intellectual Property All rights, title, and interest in and to SmartFusion (excluding content provided by users) are and will remain the exclusive property of SmartFusion and its licensors.

Disclaimers and Limitation of Liability SmartFusion is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. In no event shall SmartFusion be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use SmartFusion; (b) any conduct or content of any third party on SmartFusion, (c) any content obtained from Smartfusion; and (d) unauthorized access, use, or alteration of your transmissions or content.

Amendments to Terms We reserve the right to amend these Terms of Use at any time and without notice. By continuing to access or use  SmartFusion after those revisions become effective, you agree to be bound by the revised terms.

Governing Law These Terms of Use shall be governed by and construed in accordance with the laws of Estonia without regard to its conflict of law provisions.
